1. Purpose

These Terms of Service (“Terms”) explain your rights and responsibilities when using any product or service operated by Combat Waffle Studios Inc. (“Combat Waffle Studios,” “we,” “our,” or “us”).
This includes our games (Ghosts of Tabor and future titles), websites, storefronts, Discord communities, and any related services (collectively, the “Services”).

By accessing or using our Services, you agree to these Terms and to our Privacy Policy.
If you don’t agree, do not use our Services.

2. Eligibility and Accounts

You must be at least 18 years old (or the minimum legal age in your country) to use our Services.
You are responsible for your account credentials and all activity under your account.
Sharing, selling, or transferring accounts is not permitted.
You may not impersonate other users, developers, or staff.
If you suspect unauthorized use of your account, notify us immediately at support@combatwaffle.com.

3. Orders, Payments, and Refunds

Purchases made through third-party platforms (Steam, PlayStation, Meta, Pico) follow those platforms’ billing and refund rules.
Purchases made directly through Combat Waffle Studios (merch, digital goods, subscriptions) follow our posted Return Policy.
We may cancel orders for fraud, pricing errors, or unauthorized payment use.

Chargebacks and Fraud

Attempting to reverse or dispute legitimate charges (“chargebacks”) after receiving digital goods is considered fraudulent.
We reserve the right to suspend or terminate accounts involved in chargebacks until the issue is resolved.

4. Subscriptions and Fees

Some Services may require a subscription.

Subscriptions renew automatically unless canceled.
Fee changes will be announced with reasonable prior notice.
Continued use after fee changes means you accept the new price.
No refunds are issued for unused subscription periods unless required by law.

5. Community Behavior and Harassment

We expect players to uphold respect and integrity across all Combat Waffle Studios spaces, including:

In-game chat and voice systems.
Official Discord servers.
Social media, Twitch streams, and community events.

You may not:

Harass, stalk, threaten, or defame players, staff, or partners.
Post hate speech, discriminatory, obscene, or extremist content.
Dox, impersonate, or share others’ private information.
Encourage or organize targeted attacks or misinformation campaigns.

Enforcement

We enforce these rules both inside and outside our games.
If you violate them, we may:

Suspend or permanently ban your account(s).
Ban your hardware or device from connecting.
Revoke in-game items or purchases gained through misconduct.
Restrict participation in our Discord or community events.
Report severe violations to platform providers or law enforcement.

No refunds or credits will be issued for content or accounts removed due to violations.

6. Cross-Platform Enforcement

Combat Waffle Studios recognizes and enforces the Terms of Service and Codes of Conduct of our platform partners — Meta, Steam, PlayStation, and Pico.
Breaking their rules within Ghosts of Tabor, Nightstalkers, or our community spaces may also result in suspension or termination of your Combat Waffle Studios account.

7. Anti-Cheat and Security Monitoring

We use automated and manual systems, including Tomahawk Anticheat, to detect cheating, tampering, and unauthorized modifications.
By playing our games, you consent to these systems collecting and analyzing gameplay and technical data for cheat prevention and security enforcement.

We may suspend, permanently ban, or revoke access to accounts found using:

Cheats, exploits, or bots.
Unauthorized third-party software.
Modified or extracted versions of game files.

8. Privacy and Data Use

Your personal data is collected and handled in accordance with our Privacy Policy.
By using our Services, you consent to data processing for account management, gameplay, anti-cheat, and community moderation.
We never sell your personal data.

9. Content and Intellectual Property

All content in our games and services, including artwork, music, characters, and code, belongs to Combat Waffle Studios or our licensors.
You may not copy, distribute, or create derivative works without written permission.

When you share content (e.g., fan art, mods, videos) in our community, you grant us a worldwide, non-exclusive, royalty-free license to display and share that content for community and promotional purposes.

10. Community Moderation & Off-Platform Conduct

We may moderate, restrict, or remove access to our Discord, websites, or other community platforms at our discretion.
Severe or repeated misconduct on third-party platforms (such as Discord or Twitch) directed at our staff, community, or intellectual property may also lead to enforcement actions, including in-game bans.

11. Limitation of Liability

To the maximum extent permitted by law:

Combat Waffle Studios is not liable for any indirect, incidental, or consequential damages (including loss of data, progress, or profits).
Our total liability for any claim shall not exceed $100 USD or the amount you paid directly to us, whichever is greater.

12. “As Is” Disclaimer

Our Services are provided “as is” and “as available.”
We make no warranties that our games or services will always be uninterrupted, secure, or error-free.
You use them at your own risk.

13. Termination

We may suspend or terminate your account or access to any Service without notice if you:

Violate these Terms, our EULA, or Platform Provider policies.
Engage in harassment, cheating, or fraudulent activity.
Misuse our intellectual property or community spaces.

Termination results in immediate loss of licenses, progress, and access to all associated digital goods.
No refunds or compensation will be provided.

14. Export Control and Sanctions

You agree to comply with all U.S. and international export laws and sanctions regulations.
You may not use or access our Services if you are located in, or acting on behalf of, a country or entity subject to U.S. trade restrictions or sanctions.

15. Health and Safety Notice (VR Users)

Ghosts of Tabor and other Combat Waffle Studios titles may include virtual reality experiences.
Some users may experience motion sickness, dizziness, or disorientation.
Stop playing immediately if you experience discomfort.
Always follow platform health and safety guidelines (Meta, PlayStation, Pico).

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, USA, excluding conflict-of-law provisions.
We encourage players to resolve disputes informally by contacting support@combatwaffle.com.
Unresolved disputes will be handled according to applicable laws or the arbitration terms of your Platform Provider.

17. Changes

We may update these Terms from time to time.
If a material change occurs, we will notify you through our website or within our Services.
Continued use after the update means you agree to the new Terms.
